Desena Web Design and Maintenance Terms & Conditions

Thank you for visiting Desena Web Design and Maintenance’s website. Please read these terms and conditions carefully before placing an order for our website packages. By placing an order for one of our website packages, you are agreeing to be bound by these terms and conditions. The Terms and Coditions are subject to change without notice.

Website Project

1. We will send the client a website quote with template (working website template without content). The client should provide feedback within five business days.
2. If the client decides to go ahead with the template, then the client should sign up for the website package.
3. During the design process the client should carefully review the website online including all content, providing feedback on any changes.
4. Final review – once the project has been completed, the client should review the completed website including all content, providing feedback on any changes within five business days.
5. Once your website is complete and you are satisfied, then we will send you the tax invoice.

Website Design

• We design brochure type websites for small businesses and non-profit organisations.
• We do not design database driven websites, CMS websites and Flash websites, however we can include some basic Flash animation on our designs to make your website more attractive and dynamic.
• We also design static ecommerce websites using PayPal Shopping Cart for processing online payment.
• We provide pure XHTML and CSS website templates which comply with W3C (World Wide Web Consortium) standards.
• The website layout will be based on the client’s choice of templates.
• • We do not design logos or any other graphic materials, but we do use Photoshop to edit images, create simple buttons, round boxes, headers, and web pages background.
• Desena Web Design link must remain in the footer area of the client’s website.
• We reserve the right to feature your website on our portfolio. We will also provide a link to your website.

Website Content

• It is the client’s responsibility to provide all content for the website and it should be sent as a word document with no more than one page per website page. We are not responsible for the content of your website.
• Clients are required to ensure that the content of their websites meets all current Australian legislations regarding publications.
• All images must be saved as JPEG, PNG, PDF, TIF, GIF or PSD. If you do not have images we can provide images to be used on the pages.
• Multimedia files are acceptable in the following formats: .wav, .mp3 and .flv.
• Desena Web Design reserves the right not to include any information supplied by the client if the information is inappropriate or offensive.

Payment

• A 50% deposit is required from any new client before the start of the project.
• Once a deposit is paid and work completed you are required to pay the balance in full within 7 working days from the date of the tax invoice.
• There will be no refund once payment has been received.
• If we do not receive the payment within seven days, we will contact the client via email to remind them of such payments. If we still do not receive the payment after the second reminder, Desena Web Design has the right to remove the client’s website from the Internet.
• Payment of website updates, adding additional pages and update PayPal of Shopping Cart must be paid in advance.
• PayPal is our preferred method of payment, however, if you want to pay by money order, cheque, or online banking transfer, we will send you our bank account details.

Website Hosting

• This is an additional and independent service and will be treated as a separate service and will be billed separately.
• Desena Web Design will provide hosting facilities for the hosting of personal and business websites through our partner – AUST DOMAINS Syra Networks.

Domain Name Registration

• This is an additional and independent service and will be treated as a separate service and will be billed separately.
• Desena Web Design will provide Domain Name Registration service to personal and business websites through our partner – AUST DOMAINS Syra Networks.
• The client is responsible for registering the website domain name.
• The client is also responsible for the accuracy of the information.

Cancellation Rights

• • The client has the right to cancel their order at any time
• If the client decides to cancel the contract after a project has commenced, the client will be liable to pay for all work done up to the point of cancellation. If no work has been completed, the deposit will be refunded in full, otherwise we will charge $60.00/page.
• The client must advise Desena Web Design by telephone or in writing of the request not to proceed with work.

Alterations

• Desena Web Design will not accept any responsibility for any alterations performed by either the client or a third party which cause errors in the site. Such alterations include, but are not limited to, additions, modifications or deletions.
• If Desena Web Design is required to correct any errors resulting from such alterations, the client will be charged at the current rate $60/page.

Search Engine Submission

• As part of our services, we will submit your website to major search engines and other business directories for FREE; however this does not guarantee a particular ranking in search results.
• We do not do search engine optimisation and website marketing. You will be solely responsible for advertising your website in search engines and business directories as well as driving the traffic to your website.
• If you are interested in tracking your website stats, then we recommend you to sign up with Google Analytics – get the code and send it to us we will put the code in every page of your website.

Technical Support and Maintenance

• Email support is provided for the lifetime of the website.
• Website maintenance will become effective once we have sent the Tax Invoice. If the client decides to maintain the website personally, we will send you a zip file which contains all of the website files and instructions on how to set it up on the computer.
• We offer FREE updating text on existing web pages, excluding image gallery, flash animation, PayPal shopping cart and adding new page.
• We can train the client how to update their websites using commercial software packages such as Microsoft Expression Web and Dreamweaver, or even to learn some basic HTML.

Copyright

• All original graphics designed and supplied by Desena Web Design, remain the property of Desena Web Design.
• Desena Web Design owns the intellectual property rights of XHTML code, CSS code, Java Script code, PHP code and other materials supplied by us.
• The client owns the copyright of all material including images, graphics, or any other material supplied by the client.
• The client will obtain all the necessary permissions and authorities in respect of the use of all copy, graphics, registered company logos, names and trademarks or any other material supplied by the client.
• No responsibility will be accepted by Desena Web Design for damages or losses incurred by the client from the use of material for which the required permission or authority has not been obtained.

Privacy Policy

This policy governs the use and disclosure by Desena Web Design of personal information of its users and how its users can access that information.

Desena Web Design collects or maintains the client's personal information on its database:

• Name
• Address
• Telephone Number
• Email Address
• Credit card details (if applicable)

All personal information submitted while placing an order will remain private and confidential. Any information provided will not be sold, reused, rented, disclosed or used for any other purpose other than to process the order and follow up with the client regarding the order. Desena Web Design will endeavour to keep your personal information as secure as reasonably possible.

The above personal information collected by Desena Web Design may be used for the following purposes:

• To administer its network;
• For billing purposes; and
• For any other purpose authorised by the Australian National Privacy Principles set out in the Privacy Act 1988.

Spam Act 2003

Desena Web Design complies with Spam Act 2003. Desena Web Design only sends email to its clients and other users who have visited Desena Web Design's website in the past and wanted to get more information about our web design services.
